Extractive Industries

To be able to operate an Extractive Industry you require Development Approval and an Extraction Licence from the Shire.

Applications for development approval will consider whether the land itself is suitable for an extractive industry. Development Approval is granted under the Shire Local Planning Scheme for a maximum of 10 years and may be subject to conditions.

An application for an Extractive Industry Licence considers matters set out in the Shire's Extractive Industry Local Law 2021. The Local Law focuses on different matters to the Local Planning Scheme such as broader off-site impacts relating to material cartage and public liability insurance. An extractive industry licence can be issued for up to 5 years.

All Extractive Industries have annual requirements to provide information and pay fees. These can include:

  • Payment of an Annual Operating Fee (Local Law)
  • Providing a contribution towards road maintenance or undertaking road maintenance works
  • Environmental monitoring responsibilities
  • Providing a plan showing the contours of excavation works carried out to date
  • Providing a copy of your public liability insurance

Approvals will also include rehabilitation responsibilities for where an extraction has been completed or the Extractive Industry ceases (including when in care and maintenance for a period of 12 months or more).
